POINT 1. PURCHASE CONDITIONS
1.1. The use of the website services by the customer always implies adherence to the Terms and Conditions, in the version published by Acexarme at the time of the purchase order. As such, it is advisable for the customer to read these General Conditions before making a purchase.
These General Conditions of Purchase will always be subject to the regulations in force at any given time, so that if any term or condition is changed by the applicable regulations (whether this change is temporary or permanent), the customer will have the rights that the applicable regulations recognize, and Acexarme will inform the customer of any other additional measures that may be adopted in their favor.
In the event of a contradiction between the provisions of the applicable regulations and the provisions of these general conditions, the provisions of the applicable regulations will apply.
Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions.
1.2. Scope of the Contract
These General Terms and Conditions of Purchase apply to the sale of all Acexarme products through its website, to consumers to whom orders can be delivered in Europe. Acexarme informs that its website is exclusively aimed at an audience over the age of 16. It reserves the right to cancel a user's access account if fraudulent, speculative or bad faith acts are detected in the respective use of this service.
Acexarme will send an email indicating receipt of the request. Due to the open nature of the website, and the possibility of errors occurring in the storage and transmission of digital information, we do not guarantee the accuracy and security of the information transmitted or obtained through the website, unless expressly stated otherwise therein. Nevertheless, Acexarme will make every effort to ensure that the information contained on the website is complete, truthful and correct. If there is any error in any data, it will be rectified.
1.3. The "Consumer" must provide the "Seller" with an email address, or details relating to another form of contact, that are correct and complete and accepts that the "Seller" may contact him/her using these details, if deemed necessary.
POINT 2. WARRANTIES AND INDICATION OF PRODUCT PRICE
2.1. Payment Methods
You can find the available payment methods by clicking here . We do not accept any other payment methods than those mentioned. Please do not attempt to pay by any other means than those specified. If you do so, we cannot be held responsible for loss of payment or any other damages that may arise.
2.2. Payment Processing
In the case of payment by Credit Card, all details (e.g. card number or expiry date) will be sent via encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by Acexarme, except to carry out the necessary procedures for the purchase or refund, in the case of a return, in accordance with the exercise of the right of return or to report cases of fraud to the police.
POINT 3. ORDER SECURITY
3.1. Your payment information will be encrypted from the moment you enter it until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. Acexarme shall not be liable for any damage suffered as a result of the use of electronic means of communication including, but not limited to, damage resulting from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or transmissions of viruses.
If you choose to pay by Multibanco Reference, we will start processing the order once we have received payment. If we have not received any payment within 2 calendar days of placing the order, the order will be cancelled. Payments can only be processed if the information to be used for billing can be verified.
3.2. The customer therefore consents to Acexarme issuing the corresponding purchase receipt (or simplified invoice) in electronic format, in the order purchase confirmation email. The customer may revoke this consent at any time, having the right to request the issuance of paper invoices, by formally communicating this by email to envios@acexarme.com , or in writing addressed to the Acexarme address.
POINT 4. RESERVATION OF OWNERSHIP
Acexarme retains ownership of the products until it has received full payment for all such products.
POINT 5. PRICES
5.1. The prices of the products displayed on the website include Value Added Tax (VAT). Shipping fees are applied per order. The exact price of the shipping fee will depend on the country where your order will be delivered. For additional information on shipping fees by country, please consult here .
5.2. All prices are quoted in Euros. Please note that changing the delivery country may have an impact on prices due to shipping costs.
5.3. The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted at the time of order confirmation. Please pay only the exact amount specified in the order confirmation.
5.4. Price Changes
The prices of the products presented on the website are subject to change. Acexarme reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.5. Pricing Errors
Please note that even though the website is updated, it is possible that the price information on the website may contain errors. Acexarme is not committed to the offer and reserves the right to cancel your order in the event of such an error.
5.6. Promotion Validity
The offers on the website are valid only for the time they are displayed on the website, unless otherwise stated on the website. Acexarme is not bound by any offer, and if there are any errors or mistakes in spelling, pricing or other information on the website, it reserves the right to cancel any purchase and sale concluded under such errors.
POINT 6. CONDITIONS APPLICABLE TO PROMOTIONAL CODES
6.1. When used in accordance with the established rules, a promotional code entitles the user to benefit from a promotion/discount on the purchase of a specific product or set of products, during the period indicated/associated with the promotional code/promotional campaign.
6.2. Promotional codes can be used for online purchases made on the website. The sale, exchange or donation of a promotional code is not permitted. The use of promotional codes for commercial purposes is not permitted.
6.3. The promotional code is connected to Acexarme. The use of the promotional code in connection with another brand, company or name is not permitted. The use of the promotional code in an illegal, abusive or disrespectful manner, as well as in any other way that may harm Acexarme's reputation, is also not permitted.
6.4. The use of the promotional code is subject to one use per product and/or per order. Promotional codes cannot be combined with any other promotions or offers in force.
6.5. Promotional codes are not exchangeable/redeemable for cash.
6.6. Acexarme has no obligation to reissue or refund promotional codes.
6.7. Without prejudice to any other rights, Acexarme may have/has the right to immediately invalidate the promotional code if it has reason to suspect that a promotional code is being used: in violation of the aforementioned assumptions, by usurpation or in other cases.
POINT 7. QUALITY AND GUARANTEE
Acexarme does not sell second-hand products. The products offered for sale on the website www.acexarme.com may not exactly match the real thing in terms of image and colors, due to the Internet browser and monitor used.
All products have an identification label. Do not remove the label from the purchased product if you wish to return the product.
If you decide to exercise your right to return purchased products, Acexarme has the right not to accept the return of products that are returned without the label or that have been altered from their original condition or damaged.
POINT 8. SHIPPING AND DELIVERY
8.1 Delivery: Where and When?
We deliver products from Monday to Friday. We do not ship on public holidays. We can only deliver an order if the delivery address is a home or office located in one of the countries mentioned in the list.
To receive the order, it is necessary to ensure that someone is at the address. This service does not include the option of scheduling or booking, so the delivery of the order will be made without prior contact by the carrier. We do not guarantee this deadline during periods of Promotions, Christmas or stock shortages.
8.2. Delivery Times
If you confirm your order on a business day before 12:00 p.m. and pay by Credit Card or via Paypal, your order will be shipped the following business day (weekends and holidays are not considered business days). If you choose to pay by ATM reference, we will only ship the order after we receive the payment. This may take between 2 and 3 business days.
The "Seller" shall not be liable for any failure to perform, or delay in performing, any obligation which is due to an event of force majeure, that is to say, an event, act or omission beyond its reasonable control (Force Majeure Event - which includes any event, act or omission beyond the reasonable control of the "Seller").
We will try to deliver within the expected time. As a rule, we always do this, however, we cannot guarantee timely delivery.
8.3. Force Majeure
Acexarme's performance of all or part of its obligations shall be suspended in the event of a natural event or force majeure that prevents or delays performance. The following shall be considered as such, in particular, without this list being exhaustive: wars, epidemics, riots, insurrections, social unrest, strikes of any nature and supply problems not attributable to Acexarme. The customer shall be informed of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. Should the suspension extend beyond a period of fifteen days, the customer shall have the possibility of cancelling the current order and Acexarme shall proceed to reimburse the corresponding amount within the conditions established in the Terms and Conditions.
8.4. Inspection at Time of Delivery
Upon delivery, the customer must inspect the packaging for any damage. If the products are found to be damaged, the customer must not accept delivery of the order, which will be returned. Acexarme will refund the amounts paid for the order and shipping as soon as our headquarters receives and completes the return process.
Any complaint regarding non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this period, Acexarme will not be held responsible for the loss of the order.
POINT 9. SHIPPING FEES
Shipping rates are applied per order. The exact price of each shipment depends on the country of delivery. For more details on shipping prices per country, please see the Shipping Costs page in the menu.
9.1. Free Shipping
If the customer places an order whose value exceeds the minimum order value defined as free shipping or campaign, for their country, shipping will be done at no cost, that is, free of charge.
POINT 10. RETURNS AND CANCELLATIONS
10.1. Due to the special characteristics of certain products, the following must be taken into account:
- For health and hygiene reasons, we do not accept returns or cancellations of purchases of underwear (individually or in packages), boxers, hair accessories, cosmetics, socks, sunglasses.
- Perfumery and costume jewellery items (necklaces, bracelets, rings, etc.) can only be returned via the online store if they have their original label and are presented in their original, unopened packaging and, under no circumstances, if they have been used.
- Footwear and footwear items can only be returned if they are presented in their original box and properly packaged.
- All products to be returned must retain their original label and be properly packaged.
- Furthermore, products that are not returned in the same condition as they were delivered, or that have been damaged, will not be accepted.
The above stipulations do not apply to returns in the following cases:
- of defective products or products with defects or faults;
- receipt of an erroneous product;
In these cases, the return may be made in any case in accordance with the regulations in force.

10.2. Cancelling an Order Before Shipping
The customer can cancel the order, as long as it has not yet been shipped. The customer must contact our customer support.
10.3. Return of Defective Products
The customer has the right to return the products delivered if they are found to have defects or other non-conformities in relation to the products purchased. This exception applies to cases where, at the time of purchase, the consumer was duly informed of the lack of conformity of the good and has expressly accepted it, in accordance with the applicable legal and regulatory terms. If the product has not been used, the return can be made within 15 days after receiving the order. The customer must contact customer support. If the defect is found, the customer will be reimbursed in full, including the costs of shipping the product and the costs of returning the product to us.
10.4. Return Information
If your return is justified by the existence of a defect or non-conformity with the products ordered, Acexarme will bear the shipping and return costs. If your return was made for reasons other than the justified existence of a defect or non-conformity with the products ordered, Acexarme will not reimburse the shipping costs.
Refunds will be made based on the payment method for the amount actually paid. If the customer pays by ATM reference, the customer must provide their bank details to our customer support team when initiating the return process. This information is necessary so that we can proceed with the refund to your account. The customer will receive the refund after the product(s) have been returned and processed.
For additional information about the return process and refund times, please see the Return Policy section. Please read the help instructions in that section and follow the instructions carefully to avoid unnecessary delays.
10.5. Return of Offers
It is currently not possible for a person who has received a product as a gift from another person to return it. In this case, to return it, you must contact the person who purchased it, so that they can return it, in accordance with the Return Policy .
POINT 11. RIGHT TO FREE TERMINATION OF THE CONTRACT
The customer may exercise the right to freely terminate the contract by making an unequivocal statement to that effect when sending the (free termination form) - click here .
The customer does not need to indicate the reason for terminating the contract.
In order for the free resolution period to be respected, you must notify us before the end of the 14-day period after delivery of the order.
Within a maximum period of 24 hours, we will send you an email confirming receipt of the declaration of termination of the contract.

In the event of exercising the right to freely terminate the contract, the customer will be responsible for the shipping costs for returning the item.
The customer must keep the product(s) in such a way that they can be returned in the same conditions in which they were received, without signs of use, with the original label and together with the purchase invoice.
11.1. The refund will be made using the same payment method used when placing your order, within 5 working days after receipt of the returned products.
11.2. If you made the payment via ATM, you will need to send us your IBAN to the email: suporte@acexarme.com , so that we can proceed with the refund.
The customer will not be able to freely terminate the contract in the event of purchasing products that cannot be returned, such as interior items and cosmetics, for hygiene reasons.
POINT 12. AVAILABILITY
All orders placed on the website are subject to availability. Acexarme tries to ensure that all items offered for sale on the website are in stock. However, it reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In this case, the customer will be informed and the amount paid will be refunded.
POINT 13. RESPONSIBILITY
Acexarme shall only be liable for damages suffered by the customer if such damages result from attributable breaches of Acexarme's contractual obligations towards the customer, or if liability results from applicable legal law.
13.1. If the customer has suffered damages related to the activity of the website, Acexarme's liability will be limited to:
• Damage to products;
• Reasonable and verifiable costs incurred by the customer to find the cause and amount of compensation attributable to the damage;
• The maximum reimbursement of the above compensation will be (if applicable) the price of the products in question.
13.2. Acexarme cannot be held responsible for damages suffered by third parties resulting from the use of any of our products and cannot be held responsible for damages suffered by the customer as a consequence of improper use of our products.
13.3. In the event that the customer suffers damages resulting from gross negligence or willful misconduct on the part of Acexarme, none of the limitations set out in this article shall apply.
POINT 14. APPLICABLE LAW
These general conditions and all disputes arising in relation to these general conditions, including their validity, the use of the website or any purchase made on it, shall be governed by Portuguese law.
POINT 15. INTELLECTUAL PROPERTY
The Intellectual Property rights over the “Acexarme” website, as well as its contents and information, belong to Ricardo Jorge da Rocha Teixeira Carvalho.
All intellectual property rights over the text, images, sound, software and other content of the website belong to “Acexarme”. Research, printing, downloading to disk or distribution to other people is permitted, but in all cases for exclusively private and non-commercial purposes.
The user acknowledges the intellectual property rights over the contents of the website that do not come from third parties and is solely and exclusively responsible for the improper use of the information to which he/she has access within the scope of this website.
“Acexarme”, by allowing access to its website, is not granting any license or rights. The use of the website contents is only permitted for personal purposes.
POINT 16. AMENDMENT OF TERMS AND CONDITIONS
Acexarme has the right to change these Terms and Conditions at any time. The customer is subject to the principles and terms in force at the date of his/her order, unless the law or competent authority imposes any change to them.
POINT 17. INFORMATION ON THE WEBSITE
Although Acexarme works on its website with great care, the information, texts, graphic documents, music and/or other services may contain errors or be incomplete or incorrect. It cannot be held liable for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of intent or negligence on the part of Acexarme.
POINT 18. ALTERNATIVE RESOLUTION OF CONSUMER DISPUTES
The customer may attempt to resolve any consumer dispute out of court through the “Electronic Online Dispute Resolution Platform” (provided by the European Commission), accessible at ec.europa.eu/consumers/odr .
You may also resort to any other Alternative Consumer Dispute Resolution Entity. The updated list of Alternative Consumer Dispute Resolution Entities is available on the “Consumer Portal”, at www.consumidor.gov.pt .
POINT 19. ELECTRONIC COMPLAINTS BOOK
“Acexarme” makes the electronic format of the complaints book available on the website www.acexarme.com. Access to the Digital Platform for filing a complaint is via the address https://www.livroreclamacoes.pt/inicio .
The complaint submitted in the complaints book in electronic format has the same validity as the complaint submitted in the complaints book in physical format.
