These General Purchase Conditions govern the use of the website www.acexarme.com owned by Ricardo Jorge da Rocha Teixeira Carvalho, with address at Rua 12 Nº 628, 4500-228 Espinho, Aveiro - Portugal, with NIF Nº 214461076. 

Our store is hosted by Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

POINT 1. PURCHASE CONDITIONS

1.1. The use by the customer of the website services always implies adherence to the Terms and Conditions, in the version published by Acexarme at the time of the purchase order. As such, it is advisable for the customer to read these General Conditions before making a purchase.

These General Conditions of Purchase will always be subject to the regulations in force at any time, so that if any term or condition is changed by the applicable regulations (whether this change is temporary or permanent), the customer will have the rights that applicable legislation recognizes you, and Acexarme will inform you of any other additional measure that it may adopt in your favor.

In the event of contradiction between the provisions of the applicable regulations and the provisions of these general conditions, the provisions of the applicable regulations will apply.

Any new features or tools that are added to the current store must also be subject to the Terms and Conditions.

1.2. Scope of the Contract

These General Purchase Conditions apply to the sale of all Acexarme items through its website, to consumers to whom it is possible to deliver orders in Europe. Acexarme informs that its website is aimed exclusively at an audience over 16 years old. It reserves the right to cancel a user's access account if fraudulent, speculative or bad faith acts are detected in the respective use of this service.

Acexarme will send an email indicating receipt of the order. Due to the open nature of the website, and the possibility that errors may occur in the storage and transmission of digital information, we do not guarantee the accuracy and security of the information transmitted or obtained through the website, unless expressly provided otherwise therein. However, Acexarme will make every effort to ensure that the information contained on the website is complete, true and correct. If there is any error regarding any data, it will be rectified.

1.3. The "Consumer" must provide the "Seller" with an email address, or data relating to another form of contact, which are correct and complete and accepts that the "Seller" can contact him using this data, if he deems necessary.

POINT 2. GUARANTEES AND INDICATION OF PRODUCT PRICE

2.1. Payment methods 

You can find the available payment methods by clicking here . We do not accept any other payment methods other than those mentioned. Please do not attempt to pay by any means other than specified. If you do, we cannot be held responsible for loss of payment or any other damages that may arise.

2.2. Payment Processing 

In the case of payment by Credit Card, all details (eg card number or expiration date) will be sent via encrypted protocol to the company that provides remote electronic payment services, without third parties having access to the transmitted information. This information will not be used by Acexarme, except to carry out the necessary procedures for the purchase or reversal, in the case of a return, in accordance with the exercise of the right of return or for reporting cases of fraud to the police.

POINT 3. ORDER SECURITY

3.1. Your payment information will be encrypted from the moment you enter until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. Acexarme cannot be held responsible for any damage suffered as a result of the use of electronic means of communication including, but not limited to, recurrent damages from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by programs of computer used for communications or virus transmissions. 

If you choose to pay by Multibanco Reference, we will start processing the order after we have received payment. Once 2 calendar days have passed after placing the order and if we have not received any payment, it will be cancelled. Payments can only be processed if the information to be used for billing can be verified.

3.2. The customer therefore consents to Acexarme issuing the corresponding purchase receipt (or simplified invoice) in electronic format, in the purchase confirmation email of the order. The customer may revoke this consent at any time, having the right to request the issuance of paper invoices, formally communicating it by email to envios@acexarme.com , or in writing addressed to the address of Acexarme.

POINT 4. RESERVE OF OWNERSHIP

Acexarme retains ownership of the products until it has received full payment for all such products.

POINT 5. PRICES

5.1. The prices of the products displayed on the website contain/include Added Value (VAT). Shipping fees apply per order. The exact price of the shipping fee will depend on the country where your order will be delivered. For additional information on shipping rates by country, see here .

5.2. Prices are all quoted in euros. Please note that changing delivery country may have an influence on prices due to shipping costs.

5.3. The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted at the time of order confirmation. Please pay only the exact amount specified in your order confirmation.

5.4. Price Changes 

The prices of the products presented on the website are subject to change. Acexarme reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

5.5. Pricing Errors 

Please note that even though the website is up to date, it is possible that the pricing information on the website may contain errors. Acexarme is not committed to the offer and reserves the right to cancel your order in the event of such an error occurring.

5.6. Promotion Validity
The offers on the site are only valid for the time they are displayed on the site, unless information to the contrary is communicated on the site. Acexarme is not bound by any offer, if there are errors or mistakes in spelling, prices or others in the information on the site, it reserves the right to cancel any purchase and sale made under such errors. 

POINT 6. CONDITIONS APPLICABLE TO PROMOTIONAL CODES 

6.1. When used in accordance with the established rules, a promotion code entitles the user to enjoy a promotion/discount on the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.

6.2. Promotional codes can be used for online purchases made on the site. It is not allowed to sell, exchange or give away a promotional code. The use of promotional codes for commercial purposes is not permitted.

6.3. The promotion code is connected with Acexarme. The use of the promotional code in connection with another brand, company or name is not permitted. It is also not allowed to use the promotional code in an illegal, abusive or disrespectful way, as well as in any other way that could harm Acexarme's reputation.

6.4. The use of the promotional code is subject to only one use per product and/or per order. Promotional codes cannot be combined with any other promotions or offers in effect. 

6.5. Promo codes are not exchangeable/exchangeable for cash.

6.6. Acexarme is under no obligation to reissue or refund promotional codes.

6.7. Without prejudice to any other rights, Acexarme may have/has the right to immediately invalidate the promotional code if it has reason to suspect that a promotional code is being used: with violation of the aforementioned assumptions, by usurpation or in other cases.

POINT 7. QUALITY AND WARRANTY

Acexarme does not sell second-hand products. The products offered for sale on the www.acexarme.com website may not exactly correspond to the real thing in terms of image and colors, due to the Internet browser and monitor used. 

All products have an identification label. Do not remove the label from the purchased product if you want to return the product. 

If you decide to exercise the right to return the purchased products, Acexarme has the right not to accept the return of products that are returned without the label or that have been altered from their original state or damaged.

POINT 8. SHIPPING AND DELIVERY

8.1 Delivery: Where and When? 

We deliver products from Monday to Friday. We do not ship on days when it is a public holiday. We can only fulfill the delivery of an order if the delivery address is a house or an office located in one of the countries mentioned in the list.

To receive the order, it is necessary to ensure that someone is at the address. This service does not include scheduling or marking options, so the delivery of the order will be carried out without prior contact by the carrier. We do not guarantee this deadline during Promotions, Christmas or out of stock periods.

8.2. Delivery times 

If you confirm your order on a business day before 12:00 noon and make the payment by credit card or via Paypal, your order will be shipped the following business day (weekends and holidays are not considered business days). If you choose to pay by ATM reference, we will only ship after receiving the payment. This can take between 2 to 3 business days.

The "Seller" will not be liable for non-compliance, or delay in fulfilling, any obligation that is due to a force majeure event, that is, an event, act or omission, beyond its reasonable control (Force Majeure Event - which includes any event, act or omission beyond the reasonable control of the "Seller"). 

We will try to deliver on time. As a rule, we always proceed in this way, however, we cannot guarantee timely delivery. 

8.3. force majeure

Acexarme's performance of all or part of its obligations will be suspended in the event of a natural event or force majeure that prevents or delays performance. They will be considered as such, in particular, without this list being limiting: wars, epidemics, riots, insurrections, social unrest, strikes of any nature and supply problems not attributable to Acexarme. The customer will be informed of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. If the suspension extends beyond a period of fifteen days, the customer will have the possibility to cancel the current order and Acexarme will refund the corresponding amount within the conditions established in the Terms and Conditions.

8.4. Inspection at the Time of Delivery 

Upon delivery, the customer must inspect the package to check for any damage. If it is found that the products are damaged, the customer must not accept delivery of the order, which will be returned. Acexarme will refund the amounts paid for the order and transport as soon as our head office receives and completes the return process.

Any claim of non-receipt of order must be made within a maximum period of 30 days from the date of placing the order. After this period, Acexarme will not be responsible for its loss.

POINT 9. SHIPPING CHARGES

Shipping fees apply per order. The exact price of each shipment depends on the country of delivery. For more details on the shipping price per country, please refer to the Shipping Fees page in the menu.

9.1. Free Shipping 

If the customer places an order whose value exceeds the minimum order value defined as free shipping or campaign, for your country, the shipment will be made at no cost, that is, free of charge.

POINT 10. RETURNS AND CANCELLATIONS

10.1. Due to the special characteristics of certain products, the following must be taken into account:

  • For reasons of health protection and hygiene, we do not accept returns or cancellations of the purchase of underwear (individual or in packs), boxers, hair accessories, cosmetics, socks, sunglasses.
  • Perfumery and jewelery items (necklaces, bracelets, rings...) can only be returned through the online store when they have their original label and are presented in their unopened original packaging and, under no circumstances, when they have been used.
  • Footwear and footwear items can only be returned if they are presented in their original box and properly packaged.
  • All products to be returned must retain the original label and be properly packaged.
  • Furthermore, products that are not returned in the same condition in which they were delivered, or that have been damaged, will not be accepted.

The above stipulations do not apply to returns in the following cases:

  • of defective products or products with defects or failures;
  • receipt of an erroneous product;

In these cases, the return can be made in any case in accordance with the regulations in force.

To return an item for another or to exchange sizes, please follow the steps in Return Policy .

10.2. Order Cancellation before Shipping 

The customer can cancel the order, as long as it has not yet been shipped. The customer should contact our customer support.

10.3. Return of Defective Products 

The customer has the right to return the products delivered if they are found to be defective or otherwise non-compliant with the products purchased. Except for the hypothesis in which, at the time of purchase, the consumer has been duly informed of the lack of conformity of the good and has expressly accepted it, under the applicable legal and regulatory terms. If the product has not been used, the return can be made within 15 days of receiving the order. The customer should contact customer support. If the defect is found, you will be refunded in full, including the cost of shipping the product and the cost of returning the product to us.

10.4. Return Information 

If your return is justified by the existence of a defect or non-compliance with the ordered products, Acexarme will bear the shipping and return costs. If your return has been made for reasons other than the justified existence of a defect or non-conformity of the ordered products, Acexarme will not refund the shipping costs. 

Refunds will be made based on the payment method for the amount actually paid. If the customer makes the payment by ATM reference, it is necessary for the customer to give his bank details to our customer support, when starting the return process. This indication is necessary for us to refund the money to your account. The customer will receive the refund after the product(s) has been returned and processed.

10.5. Return of Offers 

It is currently not possible for a person who has received a product as a gift from someone else to return it. In this case, to proceed with the return, you must contact the person who bought it, in the sense that he proceeds with the return, in accordance with the Return Policy .

POINT 11. RIGHT TO FREE TERMINATION OF THE CONTRACT

The customer may exercise the right of free termination of the contract through an unequivocal statement to that effect when sending the (free termination form) - click here . 

The customer does not need to indicate the reason for terminating the contract.

In order for the free resolution period to be respected, you must notify us before the end of the 14-day period after delivery of the order.

Within a maximum period of 24 hours, we will send you an acknowledgment of receipt of the declaration of termination of the contract by e-mail.

In case of exercise of the right of free termination of the contract, the customer will be responsible for the shipping costs of returning the article.

The customer must keep the product(s) in order to be able to return them in the same conditions in which he received them, without signs of use, with the original label and together with the purchase invoice.

11.1. The refund will be made using the same payment method used when placing your order, within a period of up to 5 working days after receiving the returned products.

11.2. If you made the payment via ATM, you will need to send us your IBAN to the email: suporte@acexarme.com , so that we can proceed with the refund.

The customer will not be able to freely terminate the contract in case of acquisition of non-returnable products, such as interiors and cosmetics, for hygiene reasons. 

POINT 12. AVAILABILITY

Fulfillment of all orders placed on the site is subject to availability. Acexarme tries to ensure that all items offered for sale on the website are in stock. However, it reserves the right not to accept any orders or cancel orders already confirmed for products that are no longer in stock. In this case, the customer will be informed and the amount paid will be refunded.

POINT 13. RESPONSIBILITY

Acexarme will only be liable for damages suffered by the customer in the event that such damages result from breaches attributable to Acexarme's contractual obligations towards the customer, or in the event that liability arises from the applicable legal law.

13.1. If the customer has suffered damages related to the activity of the website, Acexarme's liability will be limited to: 

• Damage to products; 

• Reasonable and verifiable costs incurred by the customer in finding the cause and amount of compensation attributable to the damage; 

• The maximum reimbursement of the aforementioned indemnity will be (if applicable) the price of the products in question.

13.2. Acexarme cannot be held responsible for damages suffered by third parties resulting from the use of any of our products and cannot be held responsible for damages suffered by the customer as a result of improper use of our products.

13.3. In the event that the customer suffers damage as a result of gross negligence or willful misconduct on the part of Acexarme, none of the limitations set out in this article shall apply.

POINT 14. APPLICABLE LAW

The present general conditions and all emerging disputes that are related to these general conditions, including their validity, the use of the website or any purchase therein must be governed by Portuguese law.

POINT 15. INTELLECTUAL PROPERTY

The Intellectual Property right over the “Aexarme” website, as well as its contents and information, belongs to Ricardo Jorge da Rocha Teixeira Carvalho.

All intellectual property rights over the text, images, sound, software and other contents of the website belong to “Aexarme”. Searching, printing, downloading to disk or distribution to other people is permitted, but in all cases for exclusively private and non-commercial purposes.

The user recognizes the intellectual property rights over the contents of the website that do not come from third parties and is solely and exclusively responsible for the improper use of the information to which he has access within the scope of this website. 

“Aexarme”, by allowing access to its website, is not granting any license or rights. It is only allowed to use the contents of the website for personal purposes.

POINT 16. AMENDMENT TO TERMS AND CONDITIONS 

Acexarme has the right to change these Terms and Conditions at any time. The customer is subject to the principles and terms in force at the time of his order, unless the law or competent authority imposes any amendment to them.

POINT 17. INFORMATION ON THE SITE

Although Acexarme works its website with great care, the information, texts, graphic documents, music and/or other services may contain errors or be incomplete or incorrect. It cannot be held responsible for any damage resulting from the use (or inability to use) the website, including damage caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of willful misconduct or negligence on the part of Acexarme.

ITEM 18. ALTERNATIVE CONSUMER DISPUTE RESOLUTION

The customer may try to resolve any consumer dispute out of court through the “Online Electronic Dispute Resolution Platform” (provided by the European Commission), accessible at ec.europa.eu/consumers/odr . 

You may also resort to any other Alternative Consumer Dispute Resolution Entity. The updated list of Alternative Consumer Dispute Resolution Entities is available on the “Consumer Portal”, at www.consumidor.gov.pt . 

ITEM 19. ELECTRONIC COMPLAINTS BOOK

“Acexarme” provides the electronic format of the complaints book on the website www.acexarme.com. Access to the Digital Platform for submitting a complaint is processed through the address https://www.livroreclamacoes.pt/inicio .

The complaint presented in the complaints book in electronic format has the same validity as the complaint presented in the complaints book in physical format.
